1. About This Policy

itsgrowthlab ("itsgrowthlab," "we," "us" or "our") is an AI powered marketing agency based in Los Angeles, California. This Privacy Policy explains how we collect, use, share, store and protect information when you visit itsgrowthlab.com (the "Website"), contact us, request a quote, or use our marketing, website, advertising, reputation, automation and AI services (together, the "Services").

This policy is part of our Terms of Service. By using the Website or Services, you agree to this policy. If you do not agree, please do not use them.

1.1 Who this policy covers

  • Visitors who browse the Website or fill out a form.

  • Contacts of our Clients, such as customers, leads, callers and reviewers whose information passes through the tools we run for a Client.

1.2 Our role

For information about Visitors and Clients, we decide how and why the information is used, so we act as the "business" under California law. For personal information about a Client's own customers and leads that we handle while performing the Services, we act for the Client as its "service provider." Each Client is responsible for how it collects and uses that information and for giving its own customers any notices and getting any consents that the law requires.

2. Information We Collect

2.1 Information you give us

  • Contact details such as your name, business name, job title, email address, phone number and city.
  • Details you enter in quote requests, contact forms, onboarding questionnaires and surveys.
  • Messages, emails, texts, call recordings and notes from our conversations.
  • Billing details such as billing name, address and invoice history. Card and bank numbers are handled by our payment processors, and we do not store full card numbers.
  • Anything else you choose to send us.

2.2 Client Data

To deliver the Services, Clients give us access to, or send us, business information and data from the accounts and tools we manage. We call this "Client Data." It can include:

  • Business information, brand assets, photos, videos, service lists, service areas, hours and license details.
  • Website content, analytics, search console data, call tracking data and ad account data.
  • Google Business Profile, Yelp, Facebook, Instagram and other listing, review and social account data.
  • Customer and lead information, including names, phone numbers, email addresses, service requests, job details, appointment details and notes.
  • Call recordings, voicemails, transcripts, text messages, chat messages and form entries handled by our AI receptionist, voice agents, chatbots and automations.
  • Reviews, ratings and replies, public or private.
  • Login details and access permissions you give us so we can manage your accounts.

2.3 Information collected automatically

When you use the Website, we and our providers automatically collect device and usage information, such as your IP address, approximate location, browser and device type, pages viewed, links clicked, time on page, referring page and the date and time of your visit. We collect this with cookies, pixels, tags, log files and similar tools described in the Cookies section below.

2.4 Information from other sources

We receive information from advertising and listing platforms you connect to us, analytics providers, lead and review platforms, payment processors, business directories, public sources, and referral partners.

2.5 Sensitive information

We do not ask for Social Security numbers, government ID numbers, health information, or full payment card numbers. Please do not send them to us by email, text, chat or form. If you give us account login details, we use them only to perform the Services you asked for.

3. How We Use Information

3.1 To provide and run the Services

  • Bill you, collect payment and provide support.

3.2 To communicate with you

We reply to your questions, send quotes, proposals, invoices, service updates, reports and policy notices, and tell you about our Services. You can opt out of marketing messages at any time.

3.3 To improve and develop our business

  • Analyze how the Website and Services are used and fix problems.
  • Test, tune and train our automations, prompts, workflows, AI configurations and reporting tools so they work better for all of our clients.
  • Build benchmarks, insights and case studies from aggregated or de identified information.
  • Develop new services, features and content.

3.4 For safety, security and legal reasons

  • Protect the Website, Services, our clients and the public from fraud, abuse and security threats.
  • Enforce our agreements and protect our legal rights.
  • Comply with law, court orders and lawful requests.

4. Our Right to Use Client Data

4.1 License to use Client Data

When you give us Client Data or give us access to it, you grant itsgrowthlab a worldwide, nonexclusive, royalty free, transferable and sublicensable license to use, host, store, copy, process, analyze, combine, adapt, display and create derivative works from that Client Data. We may do this to provide, secure, support, improve and promote the Services, to develop and train our systems and tools, to produce aggregated and de identified insights, and to operate and grow our business, in each case as allowed by law.

This license also covers information about your business that is already public, such as your business name, website, listings, reviews and ads.

4.2 How long we keep using it

We may keep and use Client Data for as long as you remain a Client and afterward, until you ask us to delete it. To make a deletion request, email hello@itsgrowthlab.com from an address connected to your account or include enough information for us to verify you. Ending your Services alone does not count as a deletion request.

4.3 What happens when you ask us to delete

  • We will verify your request, then delete or de identify your Client Data from our active systems within 30 days. If we need more time, we will tell you, and we will finish within 45 days.
  • We will tell our service providers to delete it as well, unless an exception below applies.
  • Your license to us for that Client Data ends once the data is deleted, except as described in the next section.

4.4 What we may keep after deletion

  • Records we are required to keep for tax, accounting, contract, insurance or legal reasons, and records we need to resolve disputes, collect fees or prevent fraud.
  • Backups, which are overwritten on a normal cycle within 90 days.
  • Aggregated or de identified information that cannot reasonably be used to identify you, your business or any person, and tools, templates, configurations and learnings we built that do not contain your personal information.
  • Information already shared with third party platforms at your direction, such as ad accounts, listings and public reviews. Those platforms follow their own policies, and you must ask them directly to remove it.
  • Public content, such as published web pages, posts and reviews, until you ask us to take it down and we are able to do so.

4.5 Your responsibilities for your customers' information

You promise that you have the right to give us Client Data, including personal information of your customers and leads, and that you have given every notice and obtained every consent the law requires for us to process it as described in this policy and your agreement with us. That includes consent to record calls and to send text messages where required.

5. How We Share Information

We share information only as described below. We do not sell personal information for money.

  • Service providers. Companies that help us run the Website and Services, such as hosting, email, text and phone providers, CRM and project tools, analytics, payment processors, security, customer support, and AI and software providers. • Platforms at your direction. Google, Meta, Yelp, directories and other platforms when we set up or manage your accounts, ads, listings and posts.
  • Advisors. Lawyers, accountants, insurers and other professional advisors under a duty of confidentiality.
  • Legal and safety. Courts, regulators and others when we believe disclosure is required by law, or is needed to protect rights, property or safety.
  • Business changes. A buyer or other party if we merge, sell assets, finance or reorganize. We will require them to honor this policy for existing information.
  • Aggregated or de identified information. We may share it with anyone.
  • With your consent or at your request.

6. Cookies, Analytics and Advertising Technologies

We use cookies and similar technologies for the following purposes:

  • Essential tools that keep the Website working and secure.
  • Analytics tools that show us how visitors use the Website.
  • Advertising and measurement tools, such as pixels and tags from Google and Meta, that help us measure our marketing and show our ads to people who visited the Website. Sharing information this way may count as "sharing" for cross context behavioral advertising under California law.

You can control cookies in your browser settings and delete cookies already stored. You can also use industry opt out tools. We honor the Global Privacy Control signal as a request to opt out of sharing for California residents. Because there is no common standard for Do Not Track browser signals, we do not respond to them.

7. Calls, Recordings and Text Messages

Some of our Services answer calls, record or transcribe conversations, and send or receive text messages for Clients. Calls with us or with a Client's AI receptionist may be recorded, transcribed and analyzed, and the person on the call may be told this at the start. If you do not want a call recorded, tell the person on the call or end the call.

8. Data Retention

We keep personal information for as long as needed for the purposes in this policy, and until you ask us to delete it where the section on Client Data applies.
